Suspect in baby kidnapping may be in U.S. illegally

BLOOMINGTON, Minn. - Federal immigration officials have placed a hold on the woman arrested Thursday in the kidnapping of an 8-month old boy, indicating that they believe she is in the United States illegally.

A spokesman for U.S. Immigration and Customs Enforcement (ICE) tells KARE 11 that an immigration detainer has been placed on Isabel Diaz Castillo.

The following is a statement from Shawn Neudauer of ICE:  

"U.S. Immigration and Customs Enforcement's (ICE) Enforcement and Removal Operations (ERO) has placed an immigration detainer on Isabel Diaz-Castillo following her Feb. 20 arrest on local charges in Minneapolis. Ms. Diaz-Castillo is not currently being held by ICE.

By issuing a detainer, ICE requests that a law enforcement agency notify ICE before releasing an alien and maintain custody of the subject for a period not to exceed 48 hours, excluding Saturdays, Sundays, and holidays, to allow ICE to assume custody. ICE places detainers only on non-U.S. citizens who are eligible for deportation."

Castillo was arrested late Thursday afternoon after a desperate search and Amber Alert issued in the disappearance of 8-month-old Carlos Orozco. Minneapolis Police say the baby was taken from his family's residence while his mother was taking a shower.

Police quickly focused on Castillo, a woman who had recently befriended Carlos' mom and according to those close to the family had paid a great deal of attention to the child.

Meantime, Castillo's brother -- Israel Diaz -- said he "can't believe" the case involving his sister.

"I don't know. That's why I need to talk with her," Diaz said from his home, where Castillo was arrested yesterday.

Diaz said his sister has two children of her own: an 11-year-old son; and a 9-year-old daughter. Diaz planned to visit his sister at the Hennepin County Jail, where she is awaiting charges. Prosecutors expect to charge her in the case on Friday.
