  • Two-year old Neegnco Xiong died Wednesday after his four-year old brother accidently shot him. The boy was playing with a gun that he apparently found in between a headboard and a mattress of a bed.

MINNEAPOLIS - A Hennepin County judge decided that a Minneapolis man will not serve prison time in connection with an accidental shooting that claimed the life of his 2-year-old son.

Kao Xiong was sentenced to 10 years probation for manslaughter and 1 year probation on child endangerment during an appearance Thursday morning. The judge also ordered him to 100 hours of community service educating the Hmong community about the dangers of firearms and making sure they are stored properly.

Prosecutors were seeking a sentence of 4 years in prison.

Xiong's 2-year-old son Neegnco was fatally shot by his 4-year old brother inside the family home on the 1900 block of S. 7th Street in December of 2012. The older boy found his father's handgun between a mattress and headboard of the bed in his parents bedroom, and the gun discharged while he was playing with it.

Defense attorney Steve Meshbesher says Xiong has accepted responsibility for his son's death, which played a major factor in his not receiving prison time.
